I'll be damned ...

I thought this law suit was going absolutely nowhere when I first heard about it, but I guess there's a judge out there who thought otherwise.

McConkey's argument is actually kind of interesting -- very technical and sufficiently abstract to appeal to the wonkier side of some dude with a gavel. I think there's still plenty of reason to be skeptical about the suit's potential success [via Althouse], but thus far I like the direction this is going.
